The following incidents are ALL of the nonjudicial punishment, discipline related administrative discharges, or court-martial convictions that closed out during the month of July.

Nonjudicial Punishment (Article 15)

A Technical Sergeant (TSgt) engaged in an unprofessional sexual relationship with an A1C the TSgt supervised.  The commander determined the TSgt violated Articles 92, UCMJ, and imposed the following punishment:  Reduction to the grade of Staff Sergeant; and a reprimand.

A Staff Sergeant (SSgt) was pulled over by a Laramie County police officer after failing to stop at a stop sign.  During the stop, the officer found the SSgt was under the influence of alcohol.  The SSgt’s BAC was .10.  The commander determined the SSgt violated Article 113, UCMJ, and imposed the following punishment:  Reduction to the grade of Senior Airman (suspended); forfeiture of $1,414.00 pay per month for 2 months; and a reprimand.

An Airman First Class (A1C) was selected for a random drug urinalysis inspection.  The A1C’s test results came back positive for THC at 844 ng/ml.  The commander determined the A1C violated Article 112a, UCMJ, and imposed the following punishment:  Reduction to the grade of Airman Basic, with reduction below Airman suspended; and a reprimand.

An A1C engaged in an unprofessional sexual relationship with a TSgt in the A1C’s chain of command.  The commander determined the A1C violated Articles 92, UCMJ, and imposed the following punishment:  Reduction to the grade of Airman (suspended); 30 days extra duty; and a reprimand. #theyknewbetter #don’tdateinyourchain

 

An Airman (Amn) was selected for a drug urinalysis inspection during a unit sweep.  The Amn’s test results came back positive for THC at 272 ng/ml.  The commander determined the Amn violated Article 112a, UCMJ, and imposed the following punishment:  Reduction to the grade of Airman Basic; forfeiture of $892.00 pay (suspended); and a reprimand.

Administrative Discharges

*Administrative Discharges resulting from misconduct, including drug abuse, almost always result in a loss of some veteran benefits, specifically education benefits like the GI Bill. A discharge characterization that is not Honorable, may also limit future employment opportunities*

 

A Senior Airman (SrA) was cited by the Colorado State Highway Patrol for: Vehicular Assault, Reckless Driving Caused Serious Bodily Injury; 3rd Degree Assault; Reckless Endangerment; Reckless Driving; and Engaged in Speed Contest.  The citation came after the SrA was driving at a high rate of speed on I-25 and crashed into another SrA’s vehicle that was also travelling at a high rate of speed. The accident left a fellow Airman, who was a passenger, in critical condition, and now has serious long-term health issues as a result of the accident.  Civilian prosecutors retained jurisdiction, so for this misconduct, the SrA received a Command-Level Letter of Reprimand (LOR), an Unfavorable Information File (UIF) was established, and the SrA was placed on a control roster.  The SrA was discharged for Misconduct, Commission of a Serious Offense, Other Serious Offense and Misconduct, Minor Disciplinary Infractions, with an Under Honorable Conditions (General) Service Characterization.

An Amn was selected for a random drug urinalysis inspection.  The Amn’s test results came back positive for THC at 25 ng/ml.  The Amn retested under the “Bickel” authority and the results came back positive for THC at 50 ng/ml.  For this misconduct, the Amn received an Article 15.  The Amn was discharged for Misconduct, Drug Abuse, with an Under Honorable Conditions (General) Service Characterization.

An Amn had a video of the Amn holding a container of marijuana from a dispensary located in Colorado.  The videos were discovered by OSI during an ongoing investigation.  For this misconduct, the Amn received an Article 15.  The Amn was discharged for Misconduct, Drug Abuse (Possession), with an Under Honorable Conditions (General) Service Characterization.

An Airman Basic (AB) was selected for a drug urinalysis inspection during a unit sweep.  The AB’s test results came back positive for THC at 272 ng/ml.  For this misconduct, the AB received an Article 15.  The AB was discharged for Misconduct, Drug Abuse, with an Under Honorable Conditions (General) Service Characterization.

An AB was selected for a drug urinalysis inspection during a unit sweep.  The AB’s test results came back positive for THC at 28 ng/ml.  The AB retested under the “Bickel” authority and the results came back positive for cocaine at 520 ng/ml.  For this misconduct, the AB received two Article 15’s.  The AB was discharged for Misconduct, Drug Abuse, with an Under Honorable Conditions (General) Service Characterization.

An AB was selected for a random drug urinalysis inspection.  The AB’s test results came back positive for cocaine at 32,587 ng/ml.  The AB was selected for another random drug urinalysis inspection, the results came back positive for cocaine at 2,236 ng/ml.  In addition, the AB was driving under the influence of alcohol and was involved in a traffic accident.  Lastly, the AB negligently failed to drive the appropriate speed limit on a gravel road, which resulted in a High Mobility Multipurpose Wheeled Vehicle (HMMWV) roll over.  The AB was convicted at a Special Court-Martial for the drug abuse, had received two Article 15’s, and a command-level Letter of Reprimand (LOR).  The AB was discharged for Misconduct, Drug Abuse and Misconduct, Minor Disciplinary Infractions, with an Under Other Than Honorable Conditions (UOTHC) Service Characterization, the most severe administrative discharge characterization.

An Amn was discharged in lieu of trial by General Court-Martial for charges of sexual assault and drunk driving.  The Amn submitted a request for discharge in lieu of trial by court-martial, the victim of the alleged sexual assault supported the discharge request rather than going to trial and the General Court-Martial Convening Authority accepted the Amn’s discharge request.  The Amn was discharged in lieu of trial by court-martial, with an Under Other Than Honorable Conditions (UOTHC) Service Characterization, the most severe administrative discharge characterization.
